Publication provides guidance on using health impact assessments to improve health in US communities

WASHINGTONThe National Research Council released a report, "Improving Health in the United States: The Role of Health Impact Assessment." The publication states that "good health is determined by more than money spent on the healthcare system. In fact, a growing body of research indicates that living conditionsincluding such factors as housing quality, exposure to pollution, and access to healthy and affordable foods and safe places to exercisehave a greater effect on health."

Aaron Wernham, M.D., a member of the Research Council committee that authored the report, is the director of the Health Impact Project, a collaboration of the Robert Wood Johnson Foundation and The Pew Charitable Trusts. He issued the following statement about the publication:

"Some of the most urgent problems facing the country, such as obesity, diabetes, asthma and injury, are shaped by the conditions in the places where we live, work and play. While the rising cost of health care is a major concern, medical care alone is not the answer. The National Research Council report found that health impact assessments (HIAs) are a promising way to help identify and address how decisions in other sectors, like transportation, agriculture and energy, will affect people's health.

"This report can be a game-changer. A similar National Research Council publication released in the 1980s helped establish the use of risk assessments for toxic substances, which have become one of the most widely used tools for bringing science into decision making. Today's report helps establish the rules of the road in the fast-growing field of HIAs.

"Setting clear standards could not have come at a better time. More and more states and communities are making HIAs a routine part of decision making in an effort to avoid unintended health consequences and build healthier communities. For example, the State of Alaska recently announced a program to incorporate HIAs into major permitting decisions. At the local level, cities such as Atlanta, Nashville and Minneapolis are using HIAs to capitalize on opportunities to improve wellness and, ultimately, reduce health-related costs in a range of projects and policy decisions."

Apple suppliers cranking out 150,000 iPhone 5 units per day (Digital Trends)

Apple has yet to confirm a single detail about its next-generation iPhone, but reports out of Taiwan suggest the company believes it?s going to be a hit.

According to Apple supply chain sources, production of Apple?s so-called iPhone 5 at Foxconn Electronics plants have ramped up to about 150,000 units per day, reports DigiTimes. In addition, lens maker Largan Precision, touch-screen maker TPK Holding, glass supplier G-Tech Optoelectronics and battery suppliers Simplo and Dynapack are all currently operating at maximum capacity, the sources said.

With this level of production, iPhone 5 shipments are expected to reach between 5 million and 6 million in September, which equals out to more than 22 million units for the fourth quarter of this year. Shipments of iPhone 4 (both GSM and CDMA versions) will drop to make room for iPhone 5.

Of course, it is still not known when Apple plans to announce the iPhone 5, let alone when anxious customers will be able to get their hands on one. General consensus of the iPhone 5 rumor mill is that the next-generation Apple handset will launch sometime in October, though it?s possible Apple will make an announcement about the device this month ? a prospect that grows increasingly unlikely as the days roll on.

An October iPhone 5 launch has become so commonplace, in fact, that some reputable outlets (like AllThingsD, for example) refer to the time frame as if its been set in stone by Steve Jobs himself (or maybe Tim Cook).

Other rumors that are beginning to appear more sure include iPhone 5 coming packed with an A5 processor (possibly dual-core), and include an 8 megapixel camera. It?s also likely that the iPhone 5 will have an edge-to-edge screen, a thinner profile, and be compatible with both GSM (AT&T) and CDMA (Verizon) radio signals. Sprint, which uses CDMA, could be added to the list of carriers in the US.

NBA owners, union talk, to meet again Thursday (AP)

NEW YORK ? NBA owners and players met for about 5 1/2 hours Wednesday, plan to resume negotiations Thursday, and could even sit down again Friday.

While neither side would say if progress is being made, the frequency of the discussions seems a good sign. They met only twice in the first two months of the lockout that began July 1.

But they went for about six hours last Wednesday, and decided they would go multiple days this week. Both sides said they could even carry over the discussions into a third consecutive day if things go well during Thursday's session.

"We agreed that we're going to sit here for as many days as we can to see whether we can make progress, but we agreed not to characterize anything at all," Commissioner David Stern said.

Both sides were cautious not to portray any optimism ? or any other feelings about what was happening in the room at a midtown hotel. They said last week they wanted details of the discussions to remain private and seem intent on keeping that vow.

"It's tough to characterize it in one fashion or another. Obviously, the more we have the opportunities to meet, talk and discuss and really try to figure out how we can put a deal together, the better, so you can characterize that as positive in a sense," union president Derek Fisher of the Lakers said. "But to characterize what comes out of the meetings and whether we're making progress or we have momentum, we can't say and it's tough to say. Until the deal is done, there is no deal."

Stern was joined on the owners' side by Deputy Commissioner Adam Silver, San Antonio Spurs owner Peter Holt, who heads the labor relations committee, and NBA senior vice president and deputy general counsel Dan Rube. The union negotiators were Fisher, executive vice president Billy Hunter, attorneys Jeffrey Kessler and Ron Klempner, and economist Kevin Murphy.

Hunter, who long held a pessimistic view of the negotiations, said he thought clearly "there's more than enough time" for a deal to be reached that would allow this season's schedule to remain intact. Training camps would likely open Oct. 3, the first preseason games are Oct. 9, and the regular season opener is Nov. 1.

Those long seemed in jeopardy as the sides remained far apart on most financial issues when the old collective bargaining agreement expired at the end of the day June 30. They then didn't meet again until Aug. 1, then not again until last Wednesday.

But both sides recognize that progress must be made soon, or the threat of losing games to a work stoppage for only the second time in league history will increase.

"There's a window here. We have an opportunity to make some progress, to try to hammer some things out," Fisher said.

"Time is running down, not necessarily out, but I think we all feel in the room that if we continue to work at it we can possibly find a way to get a deal done."

Ohio woman settles suit over laptop sex images (AP)

COLUMBUS, Ohio ? An Ohio woman on Tuesday settled a lawsuit that alleged her privacy was violated when a company grabbed sexually explicit images of her and her boyfriend from a computer she didn't know was stolen.

Absolute Software Inc. of Bellevue, Wash., improperly lifted the webcam images along with instant messages and gave them to police as part of the company's attempt to retrieve the laptop, Susan Clements-Jeffrey, a teacher in Springfield, said in her 2009 lawsuit that was scheduled for trial Sept. 12.

A federal judge ruled late last month that because Clements-Jeffrey did not realize the laptop she bought for $60 was stolen, she could argue that she had an expectation of privacy.

Clements-Jeffrey had also sued Springfield police, alleging they illegally disclosed the images and arrested her without a proper warrant.

Springfield city officials and Absolute Software denied the claims.

The lawsuit was settled Tuesday with lawyers saying they couldn't comment.

The case dates to 2008 when someone stole a laptop belonging to a vocational student at the Clark County School District, according to court records.

A ninth-grade student at a different school bought the laptop at a bus station for $40, suspecting it was stolen, and sold it for $60 to Clements-Jeffrey, a teacher at his school, court records show.

Clements-Jeffrey, 52, used the laptop to trade messages and images with her out-of-state boyfriend, not realizing that software on the computer used to trace stolen laptops had been activated and was tracking the machine's location.

She was arrested on June 25, 2008 by Springfield police, who showed her copies of the sexually explicit images. But charges of receiving stolen property were quickly dropped. Clements-Jeffrey and her boyfriend sued in March 2009.

U.S. District Court Judge Walter Rice refused to dismiss the lawsuit last month and sided with Clements-Jeffrey's arguments about why the case should continue.

Although the company "may have had a noble purpose, to assist the school district in recovering its stolen laptop, a reasonable jury could find that they crossed an impermissible boundary when they intercepted (the) plaintiffs' instant messages and webcam communications," the judge wrote.

"A reasonable jury could also find that such conduct would cause of person of ordinary sensibilities to suffer shame and humiliation," he wrote.

Because computer tracking software can't prove who was working on a stolen computer, it's common for companies to seize webcam images to prove who the culprit was, said Fred Cate, a professor of information law at Indiana University.

"The company's going to get a lot of leeway when it says, `Look, we were just trying to figure who was using this stolen computer,'" he said.

The lawsuit called to mind a 2008 case in suburban Philadelphia in which thousands of photos and screenshots were taken by school-issued laptops whose remote tracking program was sometimes left on inadvertently for months after missing laptops were located.

Lower Merion School District has settled several lawsuits over the issue.
